David A. Super, Carmack Waterhouse Professor of Law and Economics sent this letter to our NH Senate in opposition to HB 392 and why an Article V Convention is a bad idea.
He stated “Contrary to the testimony presented to the Committee last week, this legislation would do nothing to mitigate the dangers of an Article V convention.”
And, he noted “Nothing in Article V, or anywhere else in the Constitution, puts any limits on what a convention could do except that it may not deny states equal representation in the Senate. If anyone tells you that other limitations exist, I would encourage you to ask them to point you to something in Constitution that supports those safeguards. There is nothing.”
